1. Introduction These Terms of Use ("Terms") govern your access to and use of the Continuity Token ("Token"), a utility token designed for backing up non-fungible token (NFT) digital media in your digital wallet on the Cardano mainnet blockchain. By accessing, purchasing, or using the Token, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use the Token.

2. Definitions "Service" refers to the continuity and backup services provided through the use of the Token. "User" or "you" refers to any individual or entity that accesses or uses the Token. "Plan" refers to any of the three available subscription plans, each offering different levels of service and support. "Decade" refers to a ten-year period during which we guarantee the backup and continuity of your NFT media.

3. Eligibility To use the Token, you must be at least 18 years old or have the consent of a parent or guardian. You also represent and warrant that you have the legal capacity to enter into these Terms and use the Service.

4. Token Plans and Pricing We offer three subscription plans for the Token, each with different features, services, and pricing. The details of each plan are available on our website. By purchasing a specific plan, you agree to pay the associated fees and receive the services outlined in that plan. All fees are non-refundable.

5. Backup and Continuity We guarantee the backup and continuity of your NFT media for at least a decade, as long as you remain a subscriber to one of our plans. This guarantee applies to NFTs that are stored in the digital wallet address associated with your account at the time of taking a snapshot. The snapshot schedule is published on our website.

6. One User Per Plan Each subscription plan is valid for one individual user only. You are not permitted to share your plan with other people. Any attempt to share your plan to another person may result in the suspension or termination of your subscription without refund.

7. Content Restrictions We reserve the right to refuse backup services for any content that we deem to be illegal, inappropriate, or otherwise unsuitable, in our sole discretion. We are not obligated to provide any explanation for our decisions in this regard. By using the Token and Service, you agree that we have full discretion to determine what content to back up and that we are not liable for any content that we choose not to back up.

8. Changes to the Service We reserve the right to modify, suspend, or discontinue the Service, in whole or in part, at any time and without notice. We will not be liable for any changes to the Service or any resulting loss or damage.

9. Intellectual Property Rights The Token and Service, including all related software, technology, and content, are the exclusive property of their respective owners. You agree not to copy, distribute, modify, or create derivative works based on the Token or Service without the express written permission of the respective owner.

10. Limitation of Liability In no event will we be liable for any direct, indirect, special, incidental, or consequential damages arising out of or in connection with your use of the Token or Service, even if we have been advised of the possibility of such damages.

11. Indemnification You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable attorney fees) arising out of or in connection with your use of the Token or Service or any violation of these Terms.

12. Governing Law These Terms and any dispute arising out of or related to them will be governed by and construed in accordance with the laws of the jurisdiction in which our company is incorporated, without regard to its conflict of law provisions.
